Boating Accidents

Boat Accident Attorneys Serving Boca Raton & Surrounding Areas

A day on the water can turn into a nightmare very quickly due to negligence, reckless operation, boating under the influence and other causes. Yachts, fishing boats, jet skis and other watercraft are required to be operated in a safe manner, yet many operators fail to do so, putting everyone on and off the boat at risk.

Florida leads the nation in boating accidents. In 2017, there were 766 boating accidents with 67 associated deaths. One-quarter of all boating accidents have drug and/or alcohol use involved. Some of the most common causes include:

  • Reckless or careless operation of a vessel
  • Operator inexperience or lack of knowledge
  • Boat equipment malfunction
  • Speeding
  • Traveling too close to other vessels
  • Failing to observe surroundings or other craft, including jet skis

Maritime/Admiralty Law

Boating accidents are more complex than those on land and usually require a different set of laws.

If you are within three nautical miles of the Atlantic and the Florida Keys, or nine miles in the Gulf of Mexico, you’ll be in state waters. Anything past those boundaries, and you’ll be subject to federal maritime law, which governs activities on the water for 200 miles from the limits of state waters.

An experienced boat accident attorney will help you understand these laws and determine which case your court will be filed in. The statute of limitations for a personal injury case filed in a Florida court is four years. But under federal maritime law, the limit is three years. Our attorneys understand the difference and will make sure your case is filed appropriately.

A boating accident can bring severe injuries, such as broken bones, spinal cord injuries and traumatic brain injuries. You may be incapacitated for weeks, months, or even become permanently disabled.

The most common reason for lawsuits related to boating accidents is negligence. If someone else was responsible for your accident, you may be able to recover compensation for:

  • Medical expenses, including medications, therapies and supplies
  • Pain & suffering
  • Lost wages
  • Lost earning capacity
  • Property damage
  • Wrongful death
  • Other future related expenses
