The Benefits of Summary Divorce
Summary divorce is a little-known type of divorce proceedings that provide those who meet certain qualifications with a simpler, easier, and less stressful form of divorce. However, many people have not even heard of a summary divorce. But if you meet certain qualifications that establish your marriage as a short, uncomplicated one, you can save yourself a lot of hassle and move on with your life.
What Are the Qualifications?
To qualify for a summary divorce, you have to meet certain standards. While these vary from state to state, they tend to conform to a general set of rules which seek to establish the nature of your relationship. In most jurisdictions that offer summary divorce, the qualifications are:
- The marriage must have lasted no longer than five years.
- No children were produced by the marriage, although in some states this can be waived if the divorcing couple has already come up with an equitable agreement about child support payments.
- There is little in the way of realty investments, such as mortgages or property ownership.
- Combined assets must be under a certain amount, usually around $35,000.
- Personal assets must respectively be under a certain amount, usually whatever the combined assets threshold is.
The Benefits
The main benefit supplied by the summary divorce is that the duration and cost of the proceedings are much less than in a traditional divorce. Since the divorce doesn’t involve children or large assets, there is not nearly as much to litigate over. Summary divorces usually only involve a few court appearances and can be resolved rather quickly, allowing you and your ex-spouse to move on with your lives.
