Alimony, also referred to as maintenance or spousal support, is the money or support that one divorcing partner must give to the other to offer support after the divorce is final. Alimony most often comes in monetary form.
How is alimony calculated?
Many people wonder how alimony is calculated, because they want to know how much they can get out of a divorce. The amount of alimony awarded is based on many variables. First, there is the question of how long the couple has been together. If the marriage has gone on for a long time, there is the assumption that there is more interdependence. This interdependence is going to affect the two divorcing partners more than a couple married for only a year.
Secondly, there is the matter of how much money is being made by both parties. If one person has been a stay at home mom all her life, she does not make that much money and does not have many relevant skills for getting back into the workplace. In this case, the ex-husband would probably be required to pay a large amount of money for spousal support.
Another factor involved in calculating alimony is if there was any wrongdoing. In some states, the court can recognize that the marriage just wasn’t working, that there was no one at fault, but in other states, the court needs one person to blame for the breakdown of the marriage. If there is some wrongdoing, the court may feel sympathy for one spouse and award more money on account of emotional harm.
