Public Law vs. Private Law
Because the United States legal system is so complex, it is divided into many categories. One set of categories involves the types of law that are passed. There are two overarching categories of laws in the United States: public laws and private laws.
Public laws are laws that deal with relations between private individuals and the state. Specifically, public laws are those laws that relate to the public good. For example, when someone commits an act of treason, she or he has violated a public law. Or, when someone commits an act of murder, he or she has violated public law. Although it may seem that murder is between two private individuals, society has defined murder as an act affecting the public good.
Private laws are those laws that deal with relations and obligations between private parties. For example, private laws define tenant-landlord relationships. They dictate how businesses will behave with respect to other businesses. For example, if one business uses a copyrighted product of another business, then the first business has violated private law.
Because divorces are a family matter, they impact people’s personal lives. As a result, divorce laws are categorized as private laws.
