Limited Divorce
Divorce can be a very difficult process to go through. It can be helpful, however, to remember that you always have options. Speaking with a good divorce attorney can be a great way to learn about those options.
One possibility is called limited divorce. This is the legal action that is taken to begin a separation. Legally the couple is still married, and is still bound by the laws of marriage. This is generally the type of divorce used when there are no grounds for an absolute divorce or when the couple cannot come to an agreement on their own.
In these cases, the court tries to find the party who is responsible for the dispute. Once this is decided, the court will resolve issues of child custody and property division.
In order to obtain a limited divorce, one of the following must be proven:
- Desertion: This is one of the most common grounds for limited divorce. It can be actual or constructive. Actual desertion is abandonment without justification, while constructive desertion occurs when one party forces the other to leave due to misconduct.
- Malice/Cruelty: This is a terrible situation to be in. Malice and cruelty toward a spouse can lead to voluntary separation, and can be grounds for desertion as well.
- Vicious Conduct: Much like malice and cruelty, this can be grounds for desertion.
- Mutual/Voluntary Separation
