Enforcing Alimony

In many marriages, one spouse financially supports both parties. This may be because the supported spouse has a lower paying job, or this spouse may not work at all. If a divorce seems imminent, the spouse with less income may be left in a very difficult financial situation. Alimony payments are a way to continue that financial support after the divorce is complete, but not every alimony agreement suits both spouses.

Missed or excessive alimony payments are just one of many complications that can arise during and after a divorce. By working with the experienced Boca Raton alimony lawyers of Eric N. Klein & Associates, P.A. you and your spouse can reach a new agreement that suits both of you. Call us today at 561-353-2800.

Changes in Alimony

If the paying spouse suddenly loses income—due to losing a job, for example, or because of a serious injury—alimony payments may suddenly become unmanageable. That, in turn, means lost income for the person who depends on them. Spouses who have lost alimony payments sometimes try to recover those payments by force, but there is an easier way.

Unlike child support, which is enforced by law with possible jail time, alimony payments are not always court-ordered. It is possible to get the police involved with court-ordered alimony, since lack of payment would be illegal. Alimony that is not court-ordered generally cannot be forcibly extracted.

It is sometimes a better idea to work with your lawyer to renegotiate the terms of your alimony agreement with your spouse, rather than taking legal action against him or her. If  a renegotiation is not possible for any reason, and if you are in serious need of the alimony payment, you may be able to recover it by filing a lawsuit.
