Divorce Arbitration vs. Divorce Mediation

For married couples, divorce is simple: the end of a marriage. For the government, however, divorce is not as simple. The legal aspects of divorce are complex, convoluted, and confusing. The government has to make sure that the divorce process goes as smoothly as possible. One of the things that people have to consider as they get a divorce is whether they use arbitration or mediation. It is important for people to choose the process that works best for them.

For some people, mediation is a better choice. When two spouses agree to mediation, they involve a third party. The third party acts as a go-between. As a couple discusses how the divorce will unfold the mediator helps keep the tension down and helps keep fairness in the discussions. The mediator may offer suggestions as to what the spouses should do, but the mediator’s suggestions are not binding. Mediators just help decide.

Arbitration, however, is comparatively more heavy-handed. When spouses select arbitration, a third party also gets involves. In the case of arbitration, however, a judge listens to arguments and observes evidence from both sides. Then, the judge decides what each spouse gets. The key difference between arbitration and mediation, though, is that the judge’s decision is binding.

Clearly, people need to think carefully about whether they prefer divorce mediation or divorce arbitration. Some people may prefer one, while other may prefer the other.
