Different Types of Divorce
Relationships do not always play out the way that we want them to. Sometimes, this means that a divorce is on the horizon. Divorce can bring a lot of stress into your life, so in times like these it can be nice to know that you have some options. There are several different types of divorce, which all have different effects:
No-fault divorces allow for the dissolution of a marriage without proof of fault by either party. A few reasons that a couple may file for a no-fault divorce include incompatibility, irreconcilable differences, and irremediable breakdown of marriage. Under this system, either party may instigate the divorce even against the will of the other party.
At-fault divorces must have fault by at least one party in the marriage. If both parties are at fault, it must be determined which party is more at fault through comparative rectitude.
Summary divorces, which are only available in certain jurisdictions, can be used when both parties can agree on certain issues before they file for divorce. The marriage must also meet certain requirements in order to qualify for a summary divorce.
Uncontested divorce is used when the two parties can agree on all aspects of the divorce, and bring this agreement to the court. This agreement can be guided by mediators or lawyers.
